David Lurie and Harley Racer represent eleven citizens of Hopedale who have successfully challenged the Town’s waiver of its right of first refusal under M.G.L. c. 61 to obtain and preserve 130 acres of Forestland that are critical to the Town’s watershed and open space.  They have obtained a Superior Court ruling that the Town’s settlement agreement with the purchaser of the land, a railroad, lacked necessary Town Meeting approval and therefore was ineffective.

David Lurie and Harley Racer represent an owner of 77 acres that are being redeveloped in downtown Hopedale in connection with a dispute with a railroad that has blocked access across railroad tracks that bisect the property.  They have obtained a ruling by the Surface Transportation Board that the dispute is properly resolved in state court, and a ruling by the state court denying the railroad’s motion to stay the state court litigation.
